⚖️Legal framework in Algeria

Notaries practice under Law No. 06-02 of February 20, 2006 on the organization of the notary profession. They are appointed by presidential decree, attached to the Chamber of Notaries of their wilaya and supervised by the National Union of Algerian Notaries (UNNA). Their deeds are authentic — they have the same value as a final judgment and can be enforced directly.

Duties and practical role

🏠

Real estate transactions

Any sale, purchase, donation or exchange of property in Algeria must go through a notary. They draft the deed, verify property titles, collect registration fees and handle the transcription with the land registry.

👨‍👩‍👧‍👦

Inheritance and estates

They draw up the certificate of inheritance that officially recognizes the heirs, distribute assets according to Algerian law and Islamic legal rules, and ensure the transcription of property transfers to heirs.

💍

Marriage deeds and marital contracts

They authenticate marriage certificates, draft separation-of-property or community-property contracts, and register deeds affecting the couple's estate.

🎁

Donations and gifts

Any donation of real estate or significant value must be notarized to be valid. They secure the transfer and ensure the rights of reserved heirs are respected.

🏢

Company formation and transfer

Articles of association for SARL, EURL or SPA, transfer of shares, capital increases, company dissolution — founding deeds often require notary involvement.

Official powers of attorney

To legally represent someone in Algeria, particularly for the diaspora managing assets remotely, the notary draws up authentic powers of attorney recognized by all administrations.

When to call a notary?

You are buying or selling property

Mandatory. No real estate transaction in Algeria is valid without a notarized deed. This is a legal requirement, not a choice.

You are an heir to property in Algeria

The notary draws up the certificate of inheritance and organizes the distribution of the estate, even if you live abroad. They can act via power of attorney.

You want to make a donation to your children

To avoid future disputes, a notarized donation is the only secure solution, especially for real estate.

You are setting up a formal company

For SPA and certain SARL deeds, notary involvement is mandatory. They guarantee the legality of the articles of association.

You live abroad and need to act in Algeria

The notary draws up an authentic power of attorney allowing you to delegate the management of a property or estate to a trusted person in Algeria.

Notary vs other professionals

Notary vs Lawyer

The lawyer defends and advises. The notary authenticates and secures. For a contested inheritance, you need both: the notary for the official distribution, the lawyer if an heir contests it.

Notary vs Bailiff

The notary creates official deeds. The bailiff enforces decisions or records facts. They intervene at different stages.

Notary vs Lawyer for contracts

A contract drafted by a lawyer is a private agreement. A notarized deed is authentic — it has executory force without prior judgment.
