Dismissal in Algeria: rights and remedies

What are the legal conditions for dismissal in Algeria? Compensation, notice period, remedies — a practical guide for employees.

Dismissal in Algeria

Labor law is governed by Law 90-11. Any dismissal must be justified and follow a precise procedure.

Legal grounds

  • Serious misconduct: job abandonment, theft, violence, serious breach
  • Duly established professional inadequacy
  • Economic reasons: restructuring, proven economic difficulties
  • The procedure

  • Summons to a preliminary interview by registered letter.
  • Preliminary interview — the employee may be assisted.
  • Notice of dismissal with precise grounds.
  • Compliance with the notice period based on seniority.
  • Compensation

Generally one month's salary per year of seniority. In case of wrongful dismissal, the court may order reinstatement or additional compensation.

    Remedies

File with the labor inspectorate, then the court of first instance (labor chamber) in case of wrongful dismissal.
