Exequatur is the procedure by which a court decision or an arbitral award issued by a foreign jurisdiction is recognized as enforceable in Algeria, exactly like an Algerian judgment. Until a foreign judgment obtains exequatur, it practically does not exist in the eyes of the Algerian authorities.
This concerns both Algerians living abroad and those living in Algeria: a divorce granted in France, a commercial ruling issued in Canada or an arbitral award signed abroad only take effect in Algeria after this recognition.
Without exequatur, a foreign judgment can neither be enforced in Algeria (seizures, registrations, changes to civil status records) nor be relied upon before Algerian courts, the administration or consulates.
